These Terms of Service (“Terms”) apply to your use of The Untitled Magazine Boutique website and purchases from The Untitled Magazine (“we,” “us,” or “our”).

By using this website or placing an order, you agree to these Terms and our Refund Policy and Privacy Policy.

1. Products

The Untitled Magazine Boutique sells print and digital magazines and books, including current issues, archive issues, collector editions, limited editions, special editions, and signed editions.

We make reasonable efforts to present product descriptions, images, prices, condition, and availability accurately. Colors and appearance may vary depending on your screen or device.

Archive, vintage, rare, and collector editions may show natural signs of age, storage, handling, or prior display. Any known material imperfections will be described or shown where reasonably possible. Archive and collector editions are sold as is.

2. Orders and Payment

All orders are subject to availability and acceptance. Adding a product to your cart does not reserve it.

Prices are displayed in the currency indicated on the website. Shipping charges, applicable taxes, and other fees are shown during checkout where available.

We may correct pricing or product-information errors and may refuse or cancel an affected order. If we cancel an order after payment has been collected, we will refund the amount charged for the canceled product.

Customers are responsible for providing accurate billing, payment, and delivery information and for reviewing their order before completing checkout.

3. Cancellations, Returns, and Refunds

All magazine and book sales are final unless an order arrives significantly damaged in transit, the customer receives the wrong item, or a remedy is required by applicable law.

We do not accept returns or provide refunds because a customer changes their mind or no longer wants the product. Archive, collector, limited, special, and signed editions are also final sale and may show minor characteristics consistent with their age and described condition.

If a print order arrives significantly damaged or contains the wrong item, contact store@untitled-magazine.com within seven calendar days of delivery. Please include your order number and clear photographs of the item, packaging, and shipping label.

Approved claims may be resolved with a replacement, store credit, or refund, depending on product availability and the circumstances. Limited, archive, signed, collector, and sold-out editions may not be replaceable.

Digital purchases are final once access or download information has been provided. If a digital edition is defective or inaccessible because of an issue within our control, contact us so we can restore access or provide an appropriate resolution.

Orders generally cannot be canceled or changed after processing begins. If you contact us immediately after placing an order, we may attempt to assist, but cancellation or modification cannot be guaranteed.

Additional details are provided in our Refund Policy. Nothing in these Terms limits consumer rights that cannot legally be excluded.

4. Preorders

Products identified as preorders are charged when the order is placed unless otherwise stated.

Publication, release, and shipping dates are estimates and may change because of printing, production, publishing, transportation, or other delays.

If an order includes both preorder and in-stock products, the order may be held until all products are available unless separate shipping is arranged.

If we cancel a preorder because the product will not be released or supplied, we will refund the amount paid for that product.

5. Shipping and International Orders

We ship within the United States and to many international destinations. Available destinations and shipping options are shown during checkout.

If your destination is not available at checkout, contact store@untitled-magazine.com. We may be able to arrange shipping depending on the destination, product, carrier availability, and applicable restrictions.

Processing and delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, incorrect addresses, or circumstances outside our reasonable control.

International customers are responsible for customs duties, import taxes, brokerage fees, and other charges imposed by the destination country or delivery provider. These charges are not included unless expressly stated during checkout.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping or return costs caused by an incorrect address, refused delivery, unclaimed shipment, or customs rejection may be the customer’s responsibility.

6. Digital Editions

Digital magazines and books are licensed to the purchaser for personal, noncommercial use only.

Digital purchases are final once access or download information has been provided, except where the file is defective, inaccessible because of an issue within our control, or a refund is required by law.

7. Copyright and Intellectual Property

All content made available through The Untitled Magazine Boutique—including print and digital publications, articles, interviews, photographs, artwork, illustrations, videos, graphics, logos, designs, page layouts, and downloadable files—is owned by or licensed to The Untitled Magazine and is protected by copyright and other intellectual-property laws.

Purchasing a print or digital publication does not transfer copyright, reproduction rights, licensing rights, image rights, or any other intellectual-property rights to the purchaser.

Without prior written permission from The Untitled Magazine and, where applicable, the relevant copyright holder, you may not:

Copy, scan, photograph, reproduce, republish, or distribute content from our publications.
Upload, post, transmit, share, or make digital files available to another person or online platform.
Use our content in advertising, merchandise, publications, exhibitions, websites, social media, artificial-intelligence systems, datasets, or other commercial projects.
Modify, create derivative works from, sell, license, sublicense, or otherwise commercially exploit our content.

Limited quotations or uses permitted by applicable law must include appropriate credit and may not imply endorsement or affiliation.

8. Website and Third-Party Services

You may not use this website for unlawful or fraudulent purposes or attempt to interfere with its security or operation.

Our store uses third-party services, including Shopify, payment processors, and delivery carriers. Those services may be subject to their own terms and privacy policies.

We do not guarantee that the website will always be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, The Untitled Magazine and its owners, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or the purchase or use of a product.

To the fullest extent permitted by law, our total liability relating to an order will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

10. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute will be handled by a court with jurisdiction in New York, New York, except where applicable consumer law provides otherwise.

If any part of these Terms is found unenforceable, the remaining provisions will continue in effect.
